The standard of the state service "Social payment in case of loss of income in connection with caring for a child upon reaching the age of one year" is approved by Appendix 10 to the Rules for calculating (determining), the amount of social payments, assigning, recalculating, suspending, resuming, terminating and making social payments from the State Social Insurance Fund and their implementation, approved by order of the Minister of Labor and Social Protection of the Population of the Republic of Kazakhstan dated June 8, 2020 No. 217.

The right to appoint an SBcc arises from the date of birth indicated in the child's birth certificate.

When the right to assign a social benefit in case of loss of income arises in connection with caring for a child upon reaching the age of 1 year (SBcc) in cases of adoption (adoption) of a child (children) and appointment of custody of a child left without parental care, under the age of a year and half years?

The right to appoint an SBcc arises from the day the court decision on the adoption of a child (children) comes into force or from the day a guardian is appointed.

For what period is a social payment in case of loss of income due to caring for a child upon reaching the age of one and half years (SBcc)?

The SBcc is appointed on a monthly basis from the date of birth indicated in the child's birth certificate or from the date the court decision on the adoption of the child (children) enters into legal force or from the date of appointment of a guardian, until the day he reaches the age of one and half years inclusive.

How is a social payment assigned in case of loss of income in connection with caring for a child upon reaching the age of one and half years (SBcc) with the birth of two or more children?   

When two or more children are born, the SBcc is assigned to each child separately. 

How long does it take to apply for a social benefit for loss of income in connection with caring for a child when he or she reaches the age of one and a half years (SBcc)?   

The deadline for applying for an SBcc cannot exceed 18 months from the date of eligibility for SBcc:

- from the date of birth indicated in the birth certificate of the child; 

- in cases of adoption of a child (children) under the age of one year - from the date of entry into force of the court decision on the adoption of the child (children);

- in cases of guardianship appointment over a child left without parental care, under the age of one year - from the date of appointment of a guardian.

What documents are needed to assign a social benefit in case of loss of income in connection with caring for a child upon reaching the age of one and half years (SBcc)?

The SBcc is appointed on the basis of the following documents:     

dentity document (identity card, stateless person's card, residence permit of a foreigner) or repatriate (qandas) certificate for persons with qandas status - required for identification - or an electronic document from a digital document service required for personal identification;

2) for residents of the city Baikonur - a certificate from the department of accounting and registration of citizens for housing sector of Baikonur;

3) certificate (certificates) of the birth of the child (children) (or a certificate containing information from the birth records of civil status acts);

The specialist who receives the application and documents generates requests to the relevant IS through the e-government gateway:

  • in the IS State database "Individuals" on the documents proving the identity of the applicant;

in the IS of second-tier banks according to information about the number of a bank account opened with banks and (or) organizations carrying out certain types of banking operations, or a cash control account of a correctional institution;

  • in the IS " CR" on the birth certificate of the child (children) or a certificate containing information from the civil status records on birth, on the adoption of the child (children), on marriage or a certificate containing information from the civil status records on marriage (in cases of change of the parent's surname contained in the information received), on the death of the child (children) or a certificate containing information from the civil status records on death.

In case of inconsistency (absence) of information in the IS, the relevant documents are attached to the application, with the exception of information about the bank account number.

If necessary (depending on their availability), the following is presented:

1) a document confirming registration of the birth of a child outside the Republic of Kazakhstan, issued by competent authorities of foreign states in the presence of consular legalization or a special stamp (apostille) (if any);

2) certificate(s) of death of the child(ren)

3) in cases of adoption (adoption) of a child (children) under the age of one year - an extract from the court decision on the adoption (adoption) of a child (children), issued by the body exercising the functions of guardianship or guardianship;

4) in case of establishment of guardianship (guardianship), a document confirming the establishment of guardianship (guardianship) over the child shall be submitted.

Where is an application for the appointment of a social payment in case of loss of income in connection with caring for a child upon reaching the age of one and half years (SBcc)?

An application for the appointment of an SBcc is submitted:   

  • to the branch of the State Corporation "Government for Citizens" 
  •  
  • through the e-government web portal (egov.kz)

 

  • when registering  the telephone number of the subscriber device of the cellular communication of the service recipient on the e-government portal (egov.kz), a proactive service is provided, if the consent of the service recipient is received within 3 calendar days by SMS notification.

For how long is a social payment in case of loss of income in connection with caring for a child upon reaching the age of one and half years (SBcc)?

The term for the appointment of an SBcc does not exceed eight working days from the date of registration of the application with all the necessary documents at the State Corporation "Government for Citizens" (hereinafter - the State Corporation) or from the date of receipt of consent to the appointment of an SBcc through a proactive service by SMS notification from the applicant's mobile phone.

The State Social Insurance Fund has the right to verify the authenticity of the documents (information) required for the appointment of an SBcc. For these purposes, the SSIF has the right to send requests to state bodies and relevant organizations, the payer of social contributions and the applicant. At the same time, the applicant must be notified through the State Corporation in written and (or) electronic forms about the delay in making a decision on the appointment of an SBcc and the terms for extending the decision, but not more than one month.

How is the amount of social payment in case of loss of income in connection with caring for a child upon reaching the age of one and half years (SBcc) determined?

The size of the SBcc is determined by the formula:       

SBcc = AMI * IRR, where:

AMI - the average monthly income of a participant in the compulsory social insurance system for the last 24 months preceding the month of the birth of a child, adoption (adoption) of a newborn child (children);

AMI = (MI 1+ MI 2+MI 3.......+ MI 24) / 24, where:

MI - monthly income accounted for as an object of calculation of social contributions (hereinafter - SC) (income minus income from which SS are not paid, including mandatory pension contributions (hereinafter - MPC )).

IRR - income replacement ratio is 0.4. 

Example

Suppose a member of the compulsory social insurance system for 2 years before the birth of a child: 

the first year salary - 150,000 tenge (object of calculating SC excluding MPC = 150,000 tenge - 15,000 tenge = 135,000 tenge),

the second year, salary - 200,000 tenge (object of calculating SC excluding MPC = 200,000 tenge - 20,000 tenge = 180,000 tenge)).

Incomes for each month are determined on the basis of the SC received by the State Social Insurance Fund from the SC calculation object. 

Amount of income for 24 months: 12 months. * 135 000 tenge + 12 months. * 180,000 tenge = 3,780,000 tenge. 

The amount received is divided by 24: AMI = 3,780,000 tenge / 24 = 157,500 tenge.

Income Replacement Rate (IRR) = 0.4

SBcc = AMI * IRR = 157,500 tenge * 0.4 = 63,000 tenge

Of the specified amount, 10% of the MPC 6,300 tenge is withheld and transferred to the beneficiary's account in the Unified Accumulative Pension Fund. If the recipient is a person with a disability of group 1 or 2 indefinitely, then the MPC is withheld on the basis of his consent.

The beneficiary's bank account will be credited with SBcc = 63,000 tenge - 6,300 tenge = 56,700 tenge on a monthly basis.

Is there a maximum amount of social payment in case of loss of income in connection with caring for a child after he reaches the age of one and half years (SBcc)?

The maximum amount of SBcc should not exceed 196 000 tenge in 2023 (40% of the 7-fold minimum wage established by the law on the republican budget on the date of the right to social benefit). 

Please note that 10% of pension contributions are withheld from the SBcc and transferred to the beneficiary's account in the Unified Accumulative Pension Fund..

Is there a minimum amount of social payment in case of loss of income in connection with caring for a child after he reaches the age of one and half years (SBcc)?

The minimum size of the SBcc from January 1, 2023 is:

- for the first child - 5.76 monthly calculation index (MCI), or 19 872 tenge; 

for the second child - 6.81 MCI, or 23 495 tenge;

for the third child - 7.85 MCI, or 27 083 tenge;

for the fourth or more child - 8.90 MCI, or 30 705 tenge.                                                                                                                                

From January 1, 2023 MCI = 3 450 tenge.

In addition to this amount, at the expense of the State Social Insurance Fund, 10% of mandatory pension contributions are transferred to the recipient's account in the Unified Accumulative Pension Fund.

To whom social payments are made in case of loss of income in connection with caring for a child upon reaching the age of one and half years (SBcc), in cases of death (recognition by the court as missing or declared dead), deprivation or restriction of parental rights, serving a sentence in places of deprivation freedom of the recipient?

The assigned amount of SBcc is made to the person caring for the child upon reaching the age of one year by decision of the branch of the State Social Insurance Fund, except for cases when the child is placed on full state support, on the basis of the following documents:

1) an identity document (for identification);

death certificates, court decisions on declaring missing or declaring dead, depriving or restricting parental rights, a court sentence on serving a sentence in places of deprivation of liberty of the recipient of social benefits in case of loss of income in connection with caring for a child upon reaching the age of one and half years;

3) an order to establish guardianship (curatorship) or an agreement on transfer to foster care or an agreement on transfer to a foster family or an agreement on transfer to a family-type orphanage.

When does the social benefit in case of loss of income in connection with the care of a child upon reaching the age of one and half years (SBcc) stop?

The SBcc is terminated from the first day of the month following the month in which the circumstance that is the basis for such termination occurred in the event of receipt of information from the information systems of state bodies and organizations:

1) on the recipient's death (declaration by the court as missing or declared dead);

2) on the provision by the recipient of false documents (information) that served as the basis for making a decision on the appointment of a social benefits;

3) in connection with the submission of the recipient's application to terminate the social benefits;

4) after the expiration of the month in which the death of the child (children) occurred;

5) after the expiration of the month in which the child (children) is (are) determined for full state support;

6) after the expiration of a month in which the parents were deprived or restricted in parental rights, the decision on adoption (adoption) was declared invalid or canceled, the guardians were released or removed from their duties, in cases established by the marriage and family legislation of the Republic of Kazakhstan.
