1. Are there any requirements for the provision of public services for the purpose of social payments in case of job loss?
The requirements for the provision of public services "Assignment of social payments in case of job loss" are approved by Appendix 3 to The rules for calculating (determining) the amount, appointment, implementation, suspension, recalculation, renewal, termination and revision of the decision on the appointment (refusal to appoint) social benefits in case of job loss, approved by the order Deputy Prime Minister - Minister of Labor and Social Protection of the Population of the Republic of Kazakhstan dated June 22, 2023 No. 237.
2. When does the right to social security payments arise in case of job loss?
The right to the appointment of the unemploymenmt social payment arises from the date of registration of a participant in the compulsory social insurance system as unemployed.
In this regard, a participant in the compulsory social insurance system applies for registration as a job seeker through the employment center or the e-government portal (egov.kz) or the Electronic Labor Exchange portal (enbek.kz). After that, within the terms established by the legislation of the Republic of Kazakhstan on employment, he is registered as unemployed.
3. Where is the application for the appointment of social payment in case of job loss
Persons eligible for the unemploymenmt social payment apply to the Fund with an application:
through the Government for Citizens State Corporation, if there is information about registration as an unemployed person.
or
через Карьерный центр – when registering a person as unemployed and applying for a social security payment based on the "one application" principle
or
through the web portal of "electronic government" (egov.kz) - if there is information about registration as unemployed
or
through the Electronic Labor Exchange portal (enbek.kz ) when registering as unemployed on the specified portal
or
through the informatization facilities of second-tier banks, if there is information about registration as an unemployed person.
During registration the telephone number of the service recipient on the e-government portal, a proactive service is provided, if the consent of the service recipient is received within 3 calendar days by SMS notification.
It is not required to submit an application when assigning a social payment through a proactive service.
4. How long can I apply for a social payment in case of job loss?
The deadline for applying for the appointment of social payment in case of job lossmay not exceed 12 months from the date of registration of a participant in the compulsory social insurance system as unemployed.
5. What documents are needed for the appointment of social benefits in case of job loss?
The SBjl is appointed on the basis of the following documents:
1) identity document (identity card, stateless person's card, residence permit of a foreigner) or repatriate (Qandas) certificate for persons with Qandas status - required for identification;
2) for residents of the city of Baikonur - a certificate from the department of accounting and registration of citizens for housing sector of the city Baikonur;
The specialist who accepts the application and documents forms requests to the relevant information systems through the e-government gateway:
1) in the IS State database "Individuals" on the documents proving the identity of the applicant;
2) in the IS of second-tier banks according to information about the number of a bank account opened with banks and (or) organizations carrying out certain types of banking operations, or a cash control account of a correctional institution;
3) in the IS "Labor Market" on the certificate of the authorized body for employment on the registration of the applicant as unemployed.
In case of inconsistency (absence) of information in the IS, the relevant documents are attached to the application, with the exception of information about the bank account number.
6. For what period is the social security payment due in case of job loss?
SBjl is assigned depending on the length of participation in the compulsory social insurance system (hereinafter - CSIS) for the following periods:
for 1 month - in the case when social contributions were made for the CSIS participant from 6 to 12 months;
for 2 months - in the case when social contributions were made for the CSIS participant from 12 to 24 months;
for 3 months - in the case when social contributions were made for the CSIS participant from 24 to 36 months;
for 4 months - in the case when social contributions were made for the CSIS participant from 36 to 48 months;
for 5 months - in the case when social contributions were made for the CSIS participant from 48 to 60 months;
for 6 months - in the case when social contributions were made for a CSIS participant from 60 months or more.
7. What is the deadline for the provision of public services for the purpose of social payment in case of job loss?
If you apply for an appointment through the Government for Citizens State Corporation or a career center, the service will be provided within six business days.
If you apply through the portal, the electronic labor Exchange portal, mobile applications of second-tier banks, or a proactive service, the deadline for assigning social benefits will be four business days.
The State Social Insurance Fund (SSIF) has the right to verify the authenticity of documents (information) necessary for the assignment of social benefits. For these purposes, the SSIF has the right to send requests to state bodies and relevant organizations, the payer of social contributions and the applicant. At the same time, the applicant is notified through the State Corporation in written and (or) electronic forms about the delay in making a decision on the appointment of the SBJL and the deadlines for extending the decision, but not more than one month.
8. How is the amount of social payment for job loss determined?
The monthly unemployment social payment amount is determined by the formula:
SBjl = AMI * IRR * LP
AMI - the average monthly income of a participant in the system of compulsory social insurance for the last 24 months preceding the month of registration as unemployed
AMI = (MI1+MI2+MI3...+MI24)/24, where:
MI - monthly income taken into account as an object of calculation of social contributions (hereinafter - SC)(income minus income from which SC are not paid, including mandatory pension contributions (hereinafter - MPC)).
KDD – income replacement rate is 0.45;
;LP- length of participation period is:
from 6 to 12 months - 0,7;
from 12 to 24 months - 0,75;
from 24 to 36 months - 0,85;
from 36 to 48 months - 0,9;
from 48 to 60 months - 0,95;
from 60 to 72 months - 1,0;
from 60 months or more, 0.02 is added to 1.0 for every twelve months of experience in the compulsory social insurance system, but not more than 1.3.
If the participation period is 72 months or more, the LP is determined by the following formula:
LP = 1.0 + 0.02 * INTEGER ((Mso – 60 months)/12 months), where
1.0 - LP with an experience of participation from sixty to seventy -two months;
The INTEGER from dividing the difference (Mco – 60 months) by 12 months is the number of full years to which the value of 0.02 is applied for each year of participation, over five years.
Mso is the total number of calendar months for which social contributions have been received.
Example:
Let's say a member of the compulsory social insurance system with 85 months of participation within 2 years before registering as unemployed:
the first year salary - 150 000 tenge (object of calculating SC excluding MPC = 150 000 tenge - 15 000 tenge = 135 000 tenge),
second year salary - 200 000 tenge (object of calculation of SC minus MPC = 200 000 tenge - 20 000 tenge = 180 000 tenge)).
Incomes for each month are determined on the basis of the SC received by the State Social Insurance Fund from the SC calculation object.
Amount of income for 24 months: 12 months * 135 000 tenge +12 months * 180 000 tenge = 3 780 000 tenge.
The amount received is divided by 24: AMI = 3 780 000 tenge / 24 = 157 500 tenge.
Income Replacement rate (CDR) = 0.45
LP = 1+ ((85 - 60)/12) full years * 0.02 = 1.04
unemployment social payment= AMI * IRR* LP= 157,500 tenge * 0.45 * 1.04 = 73,710 tenge
10% of the specified amount is retained 7,371 tenge and transferred to the recipient's account in the Unified Accumulative Pension Fund.
unemployment social payment= 73,710 tenge – 7,371 tenge =66,339 tenge on a monthly basis will be transferred to the bank account.
With more than 60 months of experience, the SBjl is assigned for 6 months.
9. In what cases is the social security payment for job loss suspended?
The unemployment social payment is suspended from the first day of the month following the month of receipt of information, including from information systems, about:
1) the absence of expenditure transactions for three or more months in the recipient's bank account. In this case, the social payment is resumed from the date of suspension.;
2) expiration of the validity period of the identity document of a foreigner or a stateless person, the certificate of candace. At the same time, the SVpr is renewed from the date of issuance of a document certifying the identity of a foreigner or a stateless person permanently residing in the territory of the Republic of Kazakhstan, the candace certificate.;
3) the applicant's submission of false information, which entailed an unjustified determination of the amount of social payment in case of job loss. At the same time, the social payment in case of job lossis resumed in the amount determined in accordance with this Code from the date of suspension.
10. When does the social payment for job loss resume?
In the case of circumstances that constitute grounds for renewal, the social payment for job loss is renewed from the date of suspension or from the date the right to renewal occurs.
11. When does the social security payment for job loss stop?

1) in case of death of the recipient (entry into force of a court decision declaring him dead). In this case, the social payment for job loss is carried out according to the month of the recipient's death (the month of entry into force of the court's decision declaring him dead), inclusive.;
2) in connection with the submission by the recipient of false documents (information) that served as the basis for making a decision on the appointment of social benefits in case of job loss. At the same time, the social payment for job loss is terminated from the date of its appointment.;
3) in connection with the submission of the recipient's application for termination of social security payment in case of job loss. At the same time, the application deadline begins on the first day of the month following the month of filing the application.;
4) from the first day of the month following the month when the recipient is de-registered as unemployed at the career center;
5) from the first day of the month following the month of receipt of information on termination of citizenship of the Republic of Kazakhstan by the recipient on the grounds provided for by the Law of the Republic of Kazakhstan "On Citizenship of the Republic of Kazakhstan".
12. Is the social security payment for job loss terminated if an unemployed person participates in subsidized jobs?
Unemployment social payment is appointed if a participant in the compulsory social insurance system is registered as unemployed, regardless of the fact of his participation in subsidized jobs, in vocational training in the direction of a career center.
13. How is the social security payment for job loss assigned if a citizen has re-registered as unemployed?
The SBjl upon subsequent application is assigned based on the fact that for each month of the previously received SBjl, 12 months are deducted from the total experience of participation in the system of compulsory social insurance. This affects the determination of the term for assigning an SBjl when applying for a SBjl again, as well as the size of the SBjl.
Example:
During the initial application for the SBjl, the employee had a total participation period of 124 months, and he was assigned a SBjl for 6 months. If he did not get a job during the specified period and received a SBjl, then upon re-registration as an unemployed person and subsequent application for another SBjl, (6 months * 12 months) = 72 months will be deducted from his total length of service.
Thus, the experience of participation for the next appointment of the SBjl will be (124 months - 72 months) = 52 months.
Accordingly, the next SBjl will be appointed for 5 months.
14. I received a salary of 1,500,000 tenge, but the assigned amount of social payment in case of job loss was less than I expected, please explain what is the reason?
The amount of the social payment in case of job loss is determined by multiplying the average monthly income recorded as an object of calculating social contributions (AMI) by the corresponding income replacement coefficients and length of service.
The AMI is determined by dividing the amount of income from which social contributions (SC) were made for the last 24 calendar months (regardless of whether there were breaks in social contributions during this period) preceding the month in which the right to social security benefits in case of job loss occurred by 24.
At the same time, in accordance with paragraph 2 of Article 245 of the Social Code of the Republic of Kazakhstan, the monthly object of calculating SC from one payer should not exceed 7 times the minimum wage (minimum wage) established for the relevant financial year by the law on the republican budget (2023: 7*70,000 tenge = 490,000 tenge, in 2024: 7*85,000 tenge = 595,000 tenge, in 2025: 7*85,000 tenge = 595,000 tenge). In this regard, if the monthly income is more than the specified amounts, then the SC is paid from 7 minimum wage.
Thus, when determining the AMI, the amount of income was determined based on this limit of 7 minimum wage.
