Answers to questions on survivor's social payments from the State Social Insurance Fund

1. Are there any requirements for the provision of public services for the purpose of social benefits in case of loss of breadwinner?

The requirements for the provision of public services "Assignment of social payment in case of loss of breadwinner" are approved by Appendix 3 to Rules for calculating (determining) the amount, appointment, implementation, suspension, recalculation, renewal, termination and revision of the decision on the appointment (refusal to appoint) social payment in case of loss of breadwinner, approved by the order Deputy Prime Minister - Minister of Labor and Social Protection of the Population of the Republic of Kazakhstan dated June 22, 2023 No. 239.

2. When does the right to social security payment arise in case of loss of a breadwinner

The right to assign a social benefit in case of loss of a breadwinner arises from the date of death indicated in the death certificate, or from the date the court decision on declaring a citizen participating in the compulsory social insurance system as deceased comes into force, or from the date indicated in the court decision on recognition him missing or being declared dead.

3. Who is entitled to social security benefits in case of loss of breadwinner

The following family members who were dependents of the deceased (recognized by the court as missing or declared dead) breadwinner who is a participant in the compulsory social insurance system have the right to appoint and receive a social payment in case of loss:

1) children including adopted, brothers, sisters and grandchildren, not reached the age of eighteen and over that age if they became disabled before reaching the age of eighteen

At the same time, brothers, sisters and grandchildren – provided that they do not have able-bodied parents or if they do not receive alimony from their parents. The specified persons over the age of eighteen who study or have studied full-time in general education or professional programs in organizations of general secondary, technical, vocational, post-secondary, higher, postgraduate education, including the period of academic leave, have the right to be appointed and receive a CPA until the time of graduation, but not more than until the achievement of twenty - three years old; They have been persons with disabilities since childhood of the first and second groups, have the right to be assigned and receive a medical certificate for the duration of the disability;

2) one of the parents or spouse, or grandfather, grandmother, brother or sister, independent from the age and employability, if he (she) is busy looking after the children, brothers, sisters or grandchildren of deceased wage earner (recognized by the court as missing), not reached the age of 3;

4. Кому назначается социальная выплата по случаю потери кормильца (СВпк)?

For all family members who were dependents of the deceased (recognized by the court as missing or  declared dead) breadwinner, who are entitled to the appointment and receipt of the SBlb, one social payment is assigned.

At the written request of a family member who was a dependent of the deceased (recognized by the court as missing or declared dead) breadwinner, his share of the social payment arise in case of loss of a breadwinner is allocated and paid to him separately.

5. How is the allocation of a share to one of the recipients of social benefits in case of loss of breadwinner

The allocation of the share of the social payments in case of loss of breadwinner is made from the date of application to the SSIF.

6. For what period is the social payment for the loss of the breadwinner assigned to persons recognized as disabled since childhood of the first or second group?

For persons recognized as disabled from childhood of the first or second group(SBlb) are assigned for the period of establishing disability.

7. How is social security payment for the loss of a breadwinner assigned if children have lost both parents?

In the event of the death of both parents participating in the compulsory social insurance system, the social security payment for the loss of a breadwinner is paid to the adoptive parent (adopter), guardian (trustee) for each lost parent.

8. How long can I apply for a social security benefit in case of loss of a breadwinner?

The period of applying for social benefits for the loss of the breadwinner cannot exceed the period of reaching the age of twenty-three years for children, including adopted children, brothers, sisters and grandchildren, who were dependent on the deceased (recognized by the court as missing or declared dead) breadwinner, on the date of application for social benefits, except for persons who became disabled before reaching the age of eighteen years.

9. What documents are needed for the appointment of social benefits in case of loss of breadwinner

SBlb are assigned on the basis of the following documents:

- an identity document (identity document, certification of stateless persons, foreigner’s residence permit) or a Kandas certificate for persons with the status of kandas (required for identity identification);

- for residents of the city of Baikonur – reference of the Department for accounting and registration of citizens of housing in the city of Baikonur;

- свидетельство (свидетельства) о рождении ребенка (детей), либо электронный документ из сервиса цифровых документов (либо справка, содержащая сведения из записей актов гражданского состояния о рождении) для идентификации;

- a death certificate of the breadwinner or a court decision declaring the person missing or declared dead;

- documents or information confirming kinship with the deceased (recognized by the court as missing or declared dead), birth certificates of the child (children) of the deceased breadwinner and on the conclusion (dissolution) of marriage (matrimony), on adoption (adoption), on the establishment of paternity (motherhood)

- certificates from the organization of secondary, technical and vocational, post-secondary, higher and (or) postgraduate education stating that family members between the ages of eighteen and twenty-three are students or full-time students (updated annually). The student's academic leave is confirmed by a certificate from the educational organization;

- when establishing guardianship, a document confirming the establishment of guardianship is submitted

Specialist receiving the application and documents forms requests to the appropriate information systems (IS) through the gateway "e-government":

- in the IS State Database " Individuals" by documents certifying the identity of the applicant;

- in the IS of second-tier banks according to the information about the number of the bank account opened in banks and (or) organizations implementing certain types of banking operations, or the control cash account of the correctional institution;

- in the IS "CR" on the birth certificate of the child (children) or a certificate containing information from the civil status records on birth, on the adoption of the child (children), on marriage or a certificate containing information from the civil status records about marriage, about the death of the breadwinner (recognized by the court as missing or declared dead) about the death of the child (children) or a certificate containing information from the civil status records about death;

- in IS "NED" according to information about full-time education of dependents in organizations of general secondary education, technical, vocational, post-secondary, higher, postgraduate education;

- in the IS "Centralized Data Bank of Persons with Disabilities" on the examination and establishment of a disability group (in the case when children, including adopted (adopted) brothers, sisters and grandchildren under the age of eighteen and older than this age, are recognized as disabled from childhood of the first or second group);

in IS "e-Custodianship" on the certificate of establishment of guardianship on the establishment of guardianship over the child

In case of inconsistency (absence) of information in the IS, the relevant documents are attached to the application, with the exception of information about the bank account number.

10. Where is the application for the appointment of social benefits in case of loss of breadwinner

The application for the appointment of the social benefits in case of loss of breadwinner is submitted:

- through the Government for Citizens State Corporation (hereinafter referred to as the State Corporation) with an identity document;

or

- through the e-government web portal

When registering the phone number of the subscriber's cellular communication device of the service recipient on the e-government portal, a proactive service is provided, if the consent of the service recipient is received within 3 calendar days by SMS notification. It is not required to submit an application when assigning a social payment through a proactive service.

At the same time, the person entitled to a share of the SVpc applies to the city and district offices of the State Corporation.

11. How long is the social payment due in case of loss of the breadwinner?

In the case of applying through the State Corporation "Government for Citizens", for the appointment of social benefits on the occasion of the loss of the breadwinnerThe term for rendering public services is eight working days. 

If you apply through the portal or through a proactive service, the deadline for assigning social benefits will be four business days.

The SSIF has the right to verify the authenticity of documents (information) required for the appointment of social benefits. For this purpose, the State Social Insurance Fund requests information from the information systems of government agencies and relevant organizations to the payer of social contributions within 4 working days. At the same time, the applicant is notified in writing by the department of the State Corporation about the delay in making a decision on the appointment of a Joint stock Company and the timing of the extension of the decision, but not for more than one month, from the date of sending the electronic mock-up of the case for verification. 

If, in order to make a decision on the appointment (refusal to appoint) a Joint stock Company, it becomes necessary to attach additional documents (information) to the electronic layout of the case (hereinafter referred to as the EMD), the SSIF branch returns the Joint Stock Company to the branch of the State Corporation with a notification of the need to finalize the documents for the appointment of the Joint Stock Company. The deadline for registration does not exceed thirty working days from the date of referral by the branch of the SSIF EMD for additional registration.

The Department of the State Corporation notifies the applicant within 3 working days from the date of receipt of the electronic notification from the SSIF:

- upon personal request of the applicant by handing over a notice of verification of documents or the need for additional documents;

- if there is a mobile phone number in the information system by sending an SMS notification to the applicant's mobile phone.

12. How is the amount of social benefits for the loss of a breadwinner determined?

The amount of monthly (SBlb) is determined by the formula:

SVpc = (CM - 50% of the minimum wage) * KDD * KSU * KKI, where:

AMI – average monthly income of a participant in the compulsory social insurance system for the last 24 months preceding the month of death of the breadwinner:

AMI = (MI 1+ MI 2+MI 3.......+ MI 24) / 24, where:

MI - monthly income, accounted for as an object of calculation of social contributions (hereinafter – SC) (income minus income from which social contributions are not paid, including compulsory pension contributions).

MW – the amount of the minimum wage established by the law on the republican budget on the date of the emergence of the right to (SBlb);

IRC is the income replacement coefficient. IRC is 0,6;

DR – dependency ratio is:

with one dependent – 0.5,

with two dependents - 0.65,

with three dependents - 0.8,

with four or more dependents - 1.0;

LP – length of participation is:

less than 6 months - 0.1;

from 6 to 12 months - 0.7;

from 12 to 24 months - 0.75;

from 24 to 36 months - 0.85;

from 36 to 48 months - 0.9;

from 48 to 60 months - 0.95;

from 60 to 72 months - 1.0;

from 60 months or more, 0.02 is added to 1.0 for every twelve months of experience in the compulsory social insurance system, but not more than 1.3.

If the participation period is 72 months or more, the CSU is determined by the following formula: 

CSU = 1.0 + 0.02 * INTEGER ((Mso – 60 months)/12 months), where

1.0 - CSU with an experience of participation from sixty to seventy -two months;

The INTEGER from dividing the difference (Mco – 60 months) by 12 months is the number of full years to which the value of 0.02 is applied for each year of participation, over five years.

Example

Suppose a system member with 85 months of participation and three dependents within 2 years prior to the date of death: 

The first year's salary - 150 000 tenge (the object of the calculation of SC minus MPC = 150 000 tenge - 15 000 tenge = 135 000 tenge),

Second year salary - 200 000 tenge (the object of SC calculation minus MPC = 200 000 tenge - 20 000 tenge = 180 000 tenge).

The income for each month is determined on the basis of the received social contributions in the SSIF from the object of calculation of social contributions. 

The amount of income for 2 years: 12 months. * 135 000 KZT + 12 months. * 180 000 tenge = 3 780 000 tenge. 

The resulting amount is divided by 24: AMI = 3 780 000 tenge / 24 = 157 500 tenge.

DR = 0.8

IRR = 0.6

IRR = 1+ ((85 months – 60 months) / 12) full years* 0.02) = 1.04

(157 500 тенге - 50% * 70 000 тенге) * 0,8 * 0,6 * 1,04 = 61 152 тенге.

(157,500 tenge - 50% * 70,000 tenge) * 0,8 * 0,6 * 1,04 = 61 152< strong> tenge.

Survivors social payment– 61 152 tenge will be transferred to the recipient's bank account on a monthly basis.

Starting from 01.01.2025, the minimum wage is 85,000 tenge. 

13. In what cases is the social payment recalculated in case of loss of the breadwinner

In the event of a change in the number of family members who were dependent on the deceased (recognized by the court as missing or declared dead) breadwinner, the SSIF decides to recalculate the Survivors social payment. At the same time, the size of the Survivors social payment increases or decreases, respectively, according to the number of family members eligible to receive Survivors social payment.

14. How is the social payment for the loss of a breadwinner recalculated in the event of an increase in the number of dependents?

With an increase in the number of dependents, the amount of the Survivors social payment is recalculated on the basis of a written application from the recipient of the social benefit, a family member who was dependent on the deceased (recognized by the court as missing or declared dead) breadwinner:

- from the date of the beginning of the study period, upon providing a certificate from the organization of general secondary, technical, vocational, post-secondary higher, postgraduate education;

- from the day of the death of the breadwinner (but not earlier than the date of birth of the child, at his birth after the death of the breadwinner), when a family member who was dependent on the deceased (recognized by the court as missing or declared dead) breadwinner is included in the dependents of the recipient of social benefits.

15. How is the social payment for the loss of the breadwinner recalculated in the event of a decrease in the number of dependents?

Recalculation of the size of the military-industrial complex in case of a decrease in the number of dependents is performed upon receipt of information from the information system government agencies and (or) organizations.

In the absence of information from the information system government agencies and (or) organizations, with a decrease in the number of dependents, отделение Government for Citizens State Corporation forms a draft decision of the Fund's branch on the appointment (recalculation) or refusal to appoint a social payment and sends it to the Fund's branch.

In the event that the applicant has not notified in a timely manner about the circumstances affecting the amount of social payments for persons who have lost a breadwinner, their amounts are reviewed from the moment of the occurrence of these circumstances, but not earlier than the moment of their appointment. 

The new SBlb is calculated by dividing the current SBlb by the current dependency ratio and multiplying the result by the newly established dependency ratio.

16. In what cases is the social payment for the loss of the breadwinner suspended?

The social payments is suspended from the first day of the month following the month of receipt of information, including from information systems, about: 

      1) the absence of spending transactions for three or more months on the recipient's bank account. At the same time, the survivors social payment is resumed from the day of suspension.;

      2) the recipient's departure for permanent residence outside the Republic of Kazakhstan.

      To a person who has left the Republic of Kazakhstan for permanent residence, who was a recipient of the survivors social payments and returned back, in case of non-receipt of payment in the country of departure, the survivors social payments is resumed from the date of termination of the survivors social payments , but not more than three years before applying for its receipt.

      At the same time, the survivors social payments is renewed in the amount established at the time of departure from the Republic of Kazakhstan. If an increase in the survivors social payments was made during the departure period, its amount is determined taking into account these increases.

      In case of receiving payments in the country of departure, the survivors social payments is renewed from the date of application, subject to registration at a permanent place of residence in the Republic of Kazakhstan in the amount established at the time of departure from the Republic of Kazakhstan.;

      3) the recipient is serving a criminal sentence imposed by the court in the form of imprisonment. In this case, the survivors social payments is made to the person appointed by the guardian (trustee) from the date of suspension.;

      4) expiration of the validity period of the identity document of a foreigner or a stateless person, the certificate of candace. At the same time, the survivors social payments is renewed from the date of issue of the identity document of a foreigner or a stateless person permanently residing in the territory of the Republic of Kazakhstan, the certificate of candace;

      5) the availability of a supporting document on the conduct of operational search activities or on the fact of missing persons in relation to the recipient and (or) dependents. At the same time, the survivors social payments is resumed from the date of entry into force of the judicial act on the cancellation of the court decision on the recognition of a missing person, but not earlier than the date of suspension.;

       6) termination by the recipient of the citizenship of the Republic of Kazakhstan on the grounds provided for by the Law of the Republic of Kazakhstan "On Citizenship of the Republic of Kazakhstan". At the same time, the survivors social payments is renewed from the date of issuance of an identity document for a foreigner or a stateless person permanently residing in the territory of the Republic of Kazakhstan.;

      7) the withdrawal of a recipient (dependent) over the age of eighteen from an educational institution or his transfer to a correspondence course. At the same time, the survivors social payments is resumed from the date of resumption of full-time education in educational institutions.;

      8) death of the recipient (entry into force of the court's decision declaring him dead). In this case, the survivors social payments is made to the person appointed by the guardian (trustee) from the date of suspension.;

      9) deprivation or restriction of the recipient's parental rights, invalidation of the decision on adoption or its cancellation. In this case, the survivors social payments is made to the person appointed by the guardian (trustee) from the date of suspension. Upon restoration of parental rights, the survivors social payments is resumed from the date of entry into force of the court's decision on the restoration or lifting of restrictions on parental rights.;

      10) the release or removal of a guardian (trustee) from performing his duties in cases established by the marriage and family legislation of the Republic of Kazakhstan. In this case, the survivors social payments is made to the person appointed by the guardian (trustee), or to the person who has been restored to the status of a guardian (trustee), from the date of suspension.;

      11) receipt of social contributions, as well as mandatory pension contributions, mandatory occupational pension contributions to individual pension accounts of persons recognized as missing or declared dead, or receipt of information confirming the fact that a citizen is alive. At the same time, if the fact of the citizen's being alive is confirmed, the social payment is terminated, in case of non–confirmation, the social payment is resumed from the date of suspension.;

      12) providing false information by the applicant, which entailed an unjustified determination of the size of the survivors social payment. In this case, the survivors social payment is resumed in the amount determined in accordance with this Code from the date of suspension. 

17. How is the social payment for the loss of a breadwinner resumed for students or full-time students?

When submitting a certificate from organizations of general secondary, technical, vocational, post-secondary, higher, postgraduate education stating that family members are full-time students or students, social payment is made on the basis of a written application, but not earlier than the start date of the study period indicated in the certificate from organizations of general secondary, technical, vocational, post-secondary, higher, and postgraduate education. 

18. How is social payment for the loss of a breadwinner resumed for persons recognized as disabled since childhood of the first or second group?

In case of re-examination of persons recognized as persons with disabilities from childhood of the first or second group, who were dependent on the deceased (recognized by the court, missing or declared dead) breadwinner, the social payment is carried out from the date of the re-examination.

19. When does the Survivor's Social Payment stop?

It stops

      1) in connection with the submission by the recipient of false documents (information) that served as the basis for making a decision on the appointment of social benefits in case of loss of the breadwinner. At the same time, the survivors social payment is terminated from the date of its appointment.;

      2) in connection with the submission of the recipient's application for termination of the survivors social payment. In this case, the survivors social payment is terminated on the first day of the month following the month of filing the application.;

      3) in connection with the death of the sole dependent of the deceased (recognized by the court as missing or declared dead) breadwinner. In this case, the survivors social payment is carried out for the month of death inclusive.;

       4) from the date of expiry of the period for establishing the disability of a dependent of the deceased (recognized by the court as missing or declared dead) breadwinner; 

      5) if the medical and social expertise unit makes a decision to recognize the dependent of the deceased (recognized by the court as missing or declared dead) breadwinner as able-bodied from the first day of the month following the month in which he was recognized as able-bodied. 

20. Are the amounts of survivor's social payment being increased on an annual basis?

Annually, recipients  of SBlb as of January 1 of the current year is increased   increased the amount of SBlb in the amount stipulated by the Government of the Republic of Kazakhstan.
