IMPLEMENTING THE “LAW AND ORDER” PRINCIPLE AS A GUARANTEE OF FAIRNESS IN THE OPERATION OF THE COMPULSORY SOCIAL INSURANCE SYSTEM

Compliance with the law in receiving social payments is an important safeguard for the social well-being of society. In this regard, cooperation between the State Social Insurance Fund JSC and law enforcement authorities plays an important role.

As part of this work, the Fund’s management held a working meeting with B. Nargoziyev, Head of the Pre-Trial Investigation Department of the Prosecutor’s Office of Kyzylorda Region.

During the meeting, the parties analysed risks arising in the assignment of social payments and considered possible schemes involving the unlawful receipt of social payments, including in Kyzylorda Region. They also discussed specific measures to prevent such practices, including improving control mechanisms, ensuring the timely detection of inaccurate information, and strengthening accountability for violations of the established procedure.

Particular attention was paid to cases involving the receipt of social payments in connection with pregnancy and childbirth in violation of legal requirements. In particular, the parties considered cases involving the submission of inaccurate information, the assignment of payments on the basis of information that did not correspond to the actual circumstances, as well as attempts to circumvent requirements established by law.

“It is essential to draw a clear distinction between the lawful entitlement to a social payment and its unlawful receipt. State social support is intended to ensure the legitimate rights of citizens. At the same time, deliberately obtaining a payment by submitting inaccurate information or through deception may result in liability under the law. In this regard, we are continuously working to identify risks in the procedures for assigning social payments, strengthen control mechanisms, and ensure strict compliance with legal requirements by the responsible employees,” said B.U. Zhunussov, First Deputy Chairman of the Management Board of the Fund.

The working meeting also considered initiatives proposed by the authorised state bodies. Following the discussion, measures were identified to improve the existing legal framework, reduce risks in the assignment of social payments, and strengthen mechanisms for preventing violations of the law.

“It is important to ensure compliance with legal requirements when assigning social payments in connection with pregnancy and childbirth, as well as to improve mechanisms for preventing potential violations. Particular attention should also be paid to official accountability. Specialists involved in the assignment of social payments must perform their official duties in strict accordance with the requirements of the applicable legislation,” said B. Nargoziyev, Head of the Pre-Trial Investigation Department of the Prosecutor’s Office of Kyzylorda Region.

Following the meeting, a number of specific tasks were identified aimed at ensuring compliance with the law in the area of social payments, addressing identified shortcomings, improving the effectiveness of controls, and preventing violations of the law. Work in this area is ongoing.
